1. Agreement
These Terms govern your use of the websites and services operated by Pacifica Foundation, Inc., a California nonprofit public benefit corporation, for KPFK 90.7 FM (“KPFK,” “we,” “us,” “our”). The sites and services covered are listed in Section 2 of our Privacy Policy, which is part of these Terms.
By using our sites, creating an account, donating, or buying a ticket, you agree to these Terms. If you do not agree, please do not use the services.
Listening to KPFK on the radio is not covered by these Terms. Over-the-air broadcasting is free and open to anyone with a receiver, and nothing here restricts that.
2. Who can use these services
You must be at least 13 years old to create an account.
You must be at least 18 and legally able to enter a contract to make a donation, start a recurring gift, or buy tickets. If you are under 18, an adult must make the transaction.
You are responsible for what happens under your account. Our sign-in is passwordless: we email you a link and a code. Keep access to your email account secure, and do not forward sign-in links to anyone. Tell us at privacy [at] kpfk.org if you think someone else has access to your account.
3. Donations
Your donation is a contribution, not a purchase
KPFK is listener-sponsored. When you donate, you are supporting the station’s operations. You are not buying goods or services, and you receive no ownership interest, no editorial control, and no influence over programming. Nothing you contribute entitles you to any say in what KPFK airs.
Donations are non-refundable
Contributions are generally non-refundable. That said, we are a community station and we behave like one. If you made a mistake — the wrong amount, a duplicate gift, an unauthorized charge, a recurring gift you meant to cancel — contact us at membership [at] kpfk.org or through the member portal and we will work it out.
Where a refund would require us to reverse a tax acknowledgment already issued, we will tell you and handle the paperwork.
Tax deductibility
Pacifica Foundation, Inc. is a 501(c)(3) organization (EIN 94-1347046). Contributions are tax-deductible to the extent allowed by law.
If you select a thank-you gift, the deductible portion of your contribution is reduced by the fair market value of that gift. We state that value at the time you choose it and on your acknowledgment. We are not your tax advisor; consult one if it matters to your situation.
Recurring gifts and memberships
When you start a recurring gift, you authorize us to charge your payment method the amount you selected, on the schedule you selected, until you cancel.
- You can cancel any time in the member portal at my.kpfk.org, or by contacting us. Cancellation stops future charges; it does not refund charges already made.
- We will tell you before your card expires and if a payment fails.
- If a payment fails, your membership benefits stay active while our payment processor retries — roughly two weeks. We would rather give you the benefit of the doubt than cut you off over an expired card.
- We will notify you before changing the amount or frequency of a recurring gift, and you will have the chance to cancel first.
- If you change your gift, the new terms apply going forward.
Pledges
If you pledge over the phone or on air and choose to be billed later, you have made a promise to pay, not a payment. We will send you a reminder. An unfulfilled pledge is not a debt we will pursue, though membership benefits tied to it do not begin until payment is received.
4. Membership and benefits
Membership benefits — access to the Pacifica Radio Archives, member events, and other benefits we may offer — depend on maintaining qualifying support as described at the time you give.
We may change benefits. If we materially reduce a benefit during a period you have already paid for, we will tell you and offer a reasonable remedy.
Membership is personal to you. Do not share your sign-in, and do not share member content with people who are not members. See Section 7.
Membership is not a voting right. Voting membership in Pacifica Foundation, Inc. is governed by Pacifica’s bylaws and its own eligibility rules, not by these Terms. Support of KPFK may make you eligible for voting membership, but the two are administered separately, and nothing here grants, guarantees, or affects any voting right.
5. Events and tickets
Buying
Ticket sales are final unless stated otherwise for a specific event. Prices, fees, and any deductible portion are shown before you pay.
Some KPFK events are ticketed by a third party — a venue or promoter with its own ticketing system. When that is the case we will say so and link you there, and their terms and privacy policy govern that purchase, not ours. Section 8 applies.
If an event changes
- Cancelled by us: you get a full refund of the ticket price, or you can convert it to a donation, your choice.
- Rescheduled: your ticket is valid for the new date. If you cannot make it, contact us and we will refund you.
- Cancelled by the venue or by circumstances beyond our control: we will do what we reasonably can, which may be limited by the venue’s own policies.
At the event
Tickets may be checked at the door. Please bring the ticket or the email. Venues have their own rules — bag checks, age restrictions, accessibility arrangements — and those apply.
Transferring tickets: you may transfer a ticket to someone else through the ticketing system, at no charge. Please do it that way rather than forwarding an email, so we know who is attending and so we can reach the right person if the event changes.
Reselling tickets above face value is not permitted. We may void tickets we believe have been resold in violation of this.
Recording at events. KPFK events are frequently photographed and recorded, and the recordings may be broadcast, published, or used to promote the station. By attending, you consent to appearing in that material. If you would rather not, tell staff at the event and we will do our best to accommodate you.
6. Thank-you gifts and fulfillment
If you select a physical thank-you gift, we will ship it to the address you gave us. Fulfillment is handled by station volunteers and can take several weeks, particularly during and after a fund drive. We appreciate your patience.
If an item is unavailable, we will offer a substitute of comparable value or ask what you would prefer. If a package is lost or arrives damaged, tell us at membership [at] kpfk.org and we will make it right.
We ship within the United States. Contact us before donating if you need international shipping.
7. Content and how you may use it
What we own and what we license
Our programming, recordings, transcripts, articles, images, logos, and site design belong to Pacifica Foundation, Inc. or to the people who created them, and are protected by copyright and trademark law.
You may listen to and share links to our freely available content, quote it with attribution, and use it for personal, noncommercial purposes. You may not republish it commercially, redistribute it as your own, use our name or logo to imply endorsement, or scrape our sites in bulk.
Some content carries rights we do not hold. Music, syndicated programming, and licensed material appear in our broadcasts under agreements that may not extend to on-demand use, which is why some archived programming is unavailable or time-limited.
Member and archive content
Content in the Pacifica Radio Archives and other member-gated material is provided for your personal listening only. You may not download it, redistribute it, share access with non-members, or use it commercially. Access is tied to your account and your qualifying support, and it ends when either does.
We may enforce this technically and by suspending accounts that violate it.
Content you submit
When you send us a comment, feedback, a message, a volunteer inquiry, or anything else, you keep ownership of it. You give us permission to use it to run the station, and — if it is the kind of thing a listener would expect us to read on air or publish, such as a comment attached to a donation — to use it in KPFK programming and promotional material, with attribution to your first name unless you asked otherwise.
We will not read your name on air unless you affirmatively told us we could. An unanswered question is a no.
Please do not send us anything you do not have the right to share, and do not send us confidential information about other people.
Host and staff accounts
If you are a KPFK host, staff member, or volunteer with an account, you get additional access under a separate set of obligations: use it only for station business, respect the privacy of listener and donor information you encounter, and do not share your access. Those obligations continue after your role ends.
8. Other sites and services
Our sites link to and embed material from elsewhere — venue ticketing sites, our vehicle and real estate donation partners, video players, social media, Pacifica network services. We do not control those and are not responsible for them. Their terms and privacy policies apply when you use them. Section 5 of our Privacy Policy explains what embedded players receive.
9. Acceptable use
Do not use our services to break the law, harass anyone, impersonate anyone, submit false information, interfere with or attack our systems, get around access restrictions or sign-in requirements, scrape or bulk-collect our content or other people’s information, submit fraudulent or stolen payment methods, or resell what we provide.
We may suspend or close an account that does any of this. Where we can, we will tell you why and give you a chance to respond.
10. Availability
We will try to keep everything running, but we cannot promise the sites will always be available, error-free, or accessible from everywhere. We may change, suspend, or discontinue any part of the services. If we discontinue something you paid for, we will offer a reasonable remedy.
We may perform maintenance with or without notice.
11. Closing your account
You can close your account any time by writing to privacy [at] kpfk.org. Closing your account cancels recurring gifts, ends membership benefits, and deletes your saved library and listening history. Our Privacy Policy explains what is deleted and what is retained.
We may close an account for violation of these Terms, fraud, or extended inactivity. Except in cases of fraud or abuse, we will give you notice and a chance to respond.
12. Editorial independence
KPFK’s programming decisions are made by the station according to Pacifica Foundation’s mission and policies. Donors, members, sponsors, underwriters, and ticket buyers do not thereby acquire influence over programming. Nothing in these Terms or in any contribution creates an obligation to air, decline to air, or alter any content.
13. Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY CONTENT WILL BE ACCURATE OR COMPLETE.
Views expressed in KPFK programming are those of the speakers and do not necessarily represent KPFK or Pacifica Foundation, Inc.
14. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, PACIFICA FOUNDATION, INC., ITS OFFICERS, DIRECTORS, EMPLOYEES, VOLUNTEERS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR USE OF THE SERVICES.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE, OR (B) ONE HUNDRED DOLLARS ($100).
Some jurisdictions do not allow these limitations, so they may not apply to you. Nothing here limits liability for fraud, willful misconduct, gross negligence, or anything else that cannot be limited by law.
15. Indemnification
If you misuse the services — violating these Terms, infringing someone’s rights, or submitting content you had no right to submit — and that causes a claim against us, you agree to cover the resulting costs. This is aimed at commercial misuse, bulk scraping, and infringement, not at ordinary listeners and donors using the site as intended.
16. Disputes and governing law
These Terms are governed by the laws of the State of California, without regard to conflict of laws principles.
Talk to us first. Before filing anything, please write to terms [at] kpfk.org and give us 30 days to resolve it. Most things get sorted this way.
Any dispute not resolved informally will be brought exclusively in the state or federal courts located in Los Angeles County, California, and you and we consent to the jurisdiction of those courts.
We do not require arbitration and we do not ask you to waive class actions. You keep your right to go to court, including small claims court, and to report a concern to any government agency.
17. General
Changes. We may update these Terms. Material changes will be posted with a new effective date and, for account holders, sent by email before taking effect. Continued use after that means you accept them. If you do not, close your account.
Whole agreement. These Terms and the Privacy Policy are the entire agreement between you and us about the services, and replace anything said before. Separate written agreements — sponsorship, underwriting, host, volunteer, employment — control where they conflict with these Terms as to their subject matter.
Severability. If any provision is unenforceable, the rest stays in effect.
No waiver. Not enforcing a provision once does not waive it.
Assignment. You may not assign these Terms. We may assign them in connection with a transfer of KPFK’s operations.
Force majeure. Neither party is liable for failure to perform due to causes beyond reasonable control.
Survival. Sections 7, 13, 14, 15, and 16 survive termination.
